Link Show v1.0 (Text/Horizontal Edition) License

The following are the terms under
                          which Spriteworks Developments licenses it's Link Show
                          v1.0 (Text/Horizontal Edition) product. By purchasing
                          a license and using this software, you agree to be
                          bound by these terms. Definitions: (a) "Licensee"
                          shall mean you, the purchaser and end-user of the Link
                          Show v1.0 (Text/Horizontal Edition) product. (b) "Link
                          Show v1.0 (Text/Horizontal Edition) product" shall
                          mean the product, Link Show v1.0 (Text/Horizontal
                          Edition) (c) "Licensing agreement" shall refer to this
                          document and confer a legally binding contract between
                          the licensor (Spriteworks Developments) and the
                          licensee (you). (d) "Spriteworks Developments" Shall
                          refer to the company with same name located at
                          http://www.spriteworks.com. (1) Link Show v1.0
                          (Text/Horizontal Edition) Licensing agreement: (1a)
                          Spriteworks Developments grants the licensee the right
                          to install a single instance of the Link Show v1.0
                          (Text/Horizontal Edition) product on a single server,
                          for use with a single domain or sub-domain and a
                          single web site. For each additional domain/subdomain
                          that the licensee wishes to use the Link Show v1.0
                          (Text/Horizontal Edition) product on, an additional
                          license must be purchased. (1b) This LICENSED script
                          and all included documentation remains, in perpetuity,
                          the sole and exclusive property of Spriteworks
                          Developments. So that we may protect our intellectual
                          property (to wit; "the Link Show v1.0 (Text/Horizontal
                          Edition) product"), the licensee agrees to comply with
                          the following criteria: (1c) The licensee shall in no
                          way reproduce the Link Show v1.0 (Text/Horizontal
                          Edition) product or include portions of it's source
                          code in other products. Nor shall the licensee
                          transmit, distribute, translate, bundle, create
                          derivative works from or provide to any third party
                          via ftp, file sharing or by any other means
                          (electronic or otherwise), access to the Link Show
                          v1.0 (Text/Horizontal Edition) product or any portion
                          thereof. (1d) The licensee shall not perform, display,
                          lease, loan, resell, sublicense, 'mirror', transfer or
                          make available in any manner to a third party any
                          portion of the Link Show v1.0 (Text/Horizontal
                          Edition) product or documentation or any abiding
                          interest therein. Nor shall the licensee "store" the
                          Link Show v1.0 (Text/Horizontal Edition) product on
                          any network other than their own domain/sub-domain
                          (wether in a password-protected folder or not). (1e)
                          The licensee shall be free to modify the Link Show
                          v1.0 (Text/Horizontal Edition) code for their own
                          personal use and at their own risk, however the
                          original license shall not be transferable without
                          express written permission from Spriteworks
                          Developments. The licensee is not permitted to resell
                          or distribute the modified code, nor the original
                          source code. Any modifications made to Link Show v1.0
                          (Text/Horizontal Edition) for the purpose of
                          customizing the product must be minimal and
                          superficial so as not to cause said product to deviate
                          radically from it's original design, functionality
                          and/or purpose. (1f) The licensee shall not remove,
                          alter or attempt to conceal in any way, the copyright
                          notices found within the Link Show v1.0
                          (Text/Horizontal Edition) product (either in the
                          source code or elsewhere) and the licensee shall
                          ensure that its personnel (including any consultants)
                          fully comply with all of the terms and conditions set
                          forth in this license and shall be liable for any
                          noncompliance(s) thereof. Removal of copyright notices
                          anywhere in the Link Show v1.0 (Text/Horizontal
                          Edition) product shall render your right to use the
                          product null and void. If for any reason it is not
                          practical for you to use the copyright notice
                          contained within this script in it's current form then
                          you must copy it (unaltered) and paste it into the
                          HEAD section of each HTML (or other) page the Link

                          script. Under no circumstances may the CSS code
                          contained within the CSS file or any portion thereof
                          be included, integrated or incorporated into the HTML
                          page containing the script or in any other document.
                          You are free to make minor modifications and/or
                          customizations to the CSS file but it must remain by
                          itself and as a separate entity at all times. You are
                          not permitted to rename this script, the CSS file or
                          convert the format of either. (1i) Spriteworks
                          Developments reserve the right to modify this license
                          agreement at any time and without prior notice and to
                          terminate a license if the licensee breaches any
                          clause(s) described in this agreement. (2) Limitations

                          (Text/Horizontal Edition)) is LICENSED, not sold.
                          Spriteworks Developments grants the licensee a
                          limited, non-exclusive, non-transferable license to
                          install and use the Link Show v1.0 (Text/Horizontal
                          Edition) product on a single domain or sub-domain and
                          in one folder only. In order to use Link Show v1.0
                          (Text/Horizontal Edition) on more than one
                          domain/sub-domain, the licensee must purchase
                          additional licenses - one for each separate
                          domain/sub-domain. (3) Refunds: Link Show v1.0
                          (Text/Horizontal Edition) is mainly comprised of
                          scripting code, a text file and images. Providing you
                          meet the minimum requirements for using the product,
                          there is really no conceivable reason why the product
                          should fail to function properly. However, if you've
                          met our minimum system requirements, and are still
                          unable to successfully install the product, you will
                          receive a full and cheerful refund of the original
                          purchase price. Refunds may be claimed within 10 days
                          of the purchase date. Please note that we are unable
                          to provide refunds in cases where a person has changed
                          their mind, cannot provide us with the information we

                          it's use. (6) Indemnification: The licensee shall
                          indemnify and hold harmless Spriteworks Developments
                          and its owners, agents and producers, from and against
                          any claims, liabilities, losses, costs, damages or
                          expenses (including attorney's fees) arising from the

                          Link Show v1.0 (Text/Horizontal Edition) product is
                          provided "as is" and without warranties of any kind
                          either expressed or implied including but not limited
                          to implied warranties of merchantability or fitness
                          for a particular purpose. (8) Governing Law: This
                          contract, as well as the licensees’ rights and
                          obligations hereunder, shall be in all respects
                          interpreted, enforced and governed by and under the
                          laws of the State of Florida and applicable federal
                          law. If a court finds that any clause in this contract
                          is unenforceable, then the remaining ones shall apply.
